Double Standard Watch: Taking a stand against Iran Posted by Alan Dershowitz and Irwin Cotler

Irwin Cotler, the former minister of justice and attorney general of Canada, member of Canadian parliament and co-author of this piece, is introducing legislation in Canadian parliament today called the "Iran Accountability Act." While it expressly holds Iran to account - for its genocidal threats, nuclear ambitions and domestic repressions - it can also function to hold any signatory to the Genocide Convention to account. All signatories to the 1948 Genocide Convention (including the United States) have a responsibility to prevent genocide - and to punish incitement to genocide - that they have largely ignored in the case of the worlds greatest threat. The IAA, while a Canadian initiative, is a template model as to how to fulfill these responsibilities and take a stand against Iranian criminal actions. We were in Geneva when the President of Iran, Mahmoud Ahmadinejad, stepped to the podium at the United Nations and delivered an address at a conference ostensibly aimed at fighting racism. With that speech - fettered with anti-Semitic comments and rooted in the very intolerance the Durban Review Conference was supposed to be combating, the whole delivered on the day of Holocaust remembrance in Geneva - the use and abuse of the United Nations reached a new, shameful low. ![]() UN Secretary-General Ban Ki-moon looks on as President Ahmadinejad is a man who incites to hatred and genocide in violation of the Genocide Convention's prohibition; who is engaged in the massive repression of the rights of his own people - particularly the Baha'i religious minority of Iran; who pursues the most destructive of weaponry in violation of UN Security Council Resolutions; who is complicit in crimes against humanity through genocidal terrorist proxies; who assaults the basic tenet of the UN Charter; who presides, as president, over the parading in the streets of Teheran of a Shahab-3 missile draped in the emblem "Wipe Israel off the Map" while exhorting the masses with cries of "Death to Israel"; who denies the Holocaust as he incites to a new one; who warns Muslims that if they recognize Israel, they will burn in the umma of Islam; and who has used the podium of the United Nations General Assembly to invoke classic anti-Semitic tropes reminiscent of the Protocols of the Elders of Zion. Such a person belongs in the docket of the accused, not the podium of the United Nations. And yet the danger of a genocidal, nuclear and rights-violating Iran did not begin with President Ahmadinejad and will not end simply with the completion of his tenure. The supreme leader of Iran, Ayatollah Ali Khamenei, stated that "it is the mission of the Islamic Republic of Iran to erase Israel from the map of the region." Indeed, when he delivered his most infamous incitement - that Israel should be "wiped off the map" - President Ahmadinejad made it clear that he was simply repeating what "the Imam said" - at once grounding his hateful prescription in the words of former supreme leader Ayatollah Ruhollah Khomeini, and invoking religion to confirm the obligation. Let us be clear, however, that the great civilization of Iran - and the people of Iran - are not the ones targeted by this legislation. To the contrary, the bill takes as its premise that these peoples are increasingly the object of Iran's human rights violations. It is in their best interest that the international community hold Iran's leaders to account. As Edmond Burke cautioned, it is clear that this evil will triumph unless good people do something to stop it. This template Iran Accountability Act would ensure precisely that. The IAA divests Canada from investment in Iran. It establishes a mechanism to monitor incitement to hate in Iran, and would render the most virulent inciters inadmissible to Canada. It freezes the assets of those that contribute to Irans nuclear or military infrastructure - as well as its machinery of hate. It uses the framework of the international community - Canada's bilateral relationships and the United Nations - to bring Iran to justice through recognized principles of international law. And, similar to a recent American legislative proposal, it targets Iran's dependence on imported petroleum - so long as the incitement continues. The IAA makes it clear that diplomacy targeted solely at Iran's nuclear threat mistakenly ignores the terrifying and vilifying context in which that threat operates and, however inadvertently, sanitizes the genocidal incitement at its core. We hope that the US government and Congress look closely at this bill. A dual statement from both Canada and the United States would send a clear signal to Iran that while we are open to engagement, we will not acquiesce in incitement to genocide and other crimes against humanity. To Ed #3. What international law? Are you referring to non-binding resolutions of the UN General Assembly--the same even-handed Assembly which has passed 750 resolutions of which 450 are against Israel? The reason the UN made those resolutions non-binding was to stop the Assembly, a pawn of the PLO, from enacting international law. As to the Security Council, there is no resolution forcing Israel to go back to its pre1967 borders since it captured the Jordanian West Bank after Jordan attacked Israel in 1967. Aggressors lose territory captured by their victims in a counterattack..

Law rests on the consent of the governed, and requires a means of enforcement. There are several codes of law extant today, English Common, Napoleonic, Sharia. Which would AD propose? Basically International Law is a farce, it has no meaning as a rule for societal conduct. Yes, it exists in sme commercial areas. The only Law that exists between nations is might makes right, all else is pure B.S. for legal academia to discuss ad nauseum.

Dershowitz and Cotler..good work on paper! Does it have "teeth" --if yes, how...worth explaining since
most legislation stays in the books or shelves -- to fight a President like A. you have to remove him from
office and give no platform to his hatred full speeches. Voila. One idea. The next suggestion is to have Iranian dissidents come on line and sign this proposed legislation -- so that the west is not seen as
dictating again what Iran should and should not be doing...Hope it helps.

What good will such an initiative do in the US in light of Pres. Obama's revisionist speech in Cairo? It is one thing to chastise Iran for genocidal threats, and quite another to acquiesce to its nuclear program as Obama did a couple weeks ago. The US can put the brunt of its criticism for rejectionism and antisemitic invective on Iran, but it does not change the fact that Obama in his address to the Arab/Muslim world adopted its farcical historical narrative & whitewashed its treatment of Jews and Israel. No such initiative, or speeches at Buchenwald, can alter the direction Obama has taken.

To begin with the entire premiss of this issue is moot. What we are dealing with here is a narcisstic man, and a compulsive liar. This is a man who lied to 300 million of the American people in order to steal his way into the highest office in the land. He is a megalomaniac with a G-d like complex. i dont know why alan dershowitz is allowed to post here. that man has no integrity whatsoever. the other day he accused the mother of finkelstein, a holocaust survivor, or being a capo by twisting finkelstein's own words. Dershowitz has only loyalty to his agenda, not to the truth. Anything goes if it serves israel.

I have been a Democrat for the past 35 years, that is until listening very carefully to Mr. Obama during his campaign. I did not vote for him as I found him to be disingenious and an opportunist. He is a very talented speaker, knowing exactly what his audience wants to hear. I come from a long line of liberal democrats, all of whom have activiely participated in political endeavors. I am sad to say that the current administration does not reflect my position on either foreign or domestic policy. Change is coming but one that does not benefit the U.S or Israel.

There is a great deal of support for Israel in the USA,unfortunately not by the current players in DC.The change this obama person wants is bad for all,the USA and Israel too.We are going thru a takeover,plain and simple.This administration wants total control of everything .THe people are not happy,even ones that voted for him are seeing the truth behind his socialism/communism agenda here.Sad.Ugly.

#17, read Obama's book. The antichrist was a tongue in cheek remark. Open your eyes. Look at the actions of the man and not the words. I don't believe everything I'm told; I investigate. Don't listen to me or the state run media. The head of GE and MSNBC are on Obama's economic advisery commitee. How much do you think this affects the reporting on MSNBC. I cannot convince you of anything. All I can say is open your eyes--search for the truth. As Fox Mulder used to say on the Xfiles, "the truth is out there." I don't hate Obama; i am just wary of his actions. I see liberty slipping away.

Hello everyone!
There have been past attempts to cause Trader Joe's to boycott Israeli products. The supermarket has resisted and on June 20 (this Saturday!), South Bay Mobilization is launching a "de-shelving campaign" against Trader Joe's in which they and others will take all of the Israeli products off the shelves. Essentially acting like vandals. Show your support by buying the Israeli products beforehand. Or better yet, wear shirts with a big Magen David and help the clerks clean up the mess. They chose Saturday to isolate observant Jews. Show your support on Friday or Sunday! Hurry!
