Double Standard Watch: Hamas has declared war on Israel - how should Israel respond?

Article 51 of the United Nations Charter guarantees its members "the inherent right to...individual self defense" against "an armed attack." In January 2006, Hamas was elected to govern the Palestinian Authority. After Israel ended its occupation of Gaza and removed all of its settlers, Hamas threw the Palestinian Authority out of the Gaza and assumed de facto as well as de jure control over the entire Gaza Strip. Its leaders then instructed its military wing to direct rockets at civilian targets in southern Israel. At first these rockets were Kassams with a relatively short range. Now they include Katyushas, which can reach Israel's large cities, including Ashkelon, with its population of 120,000 civilians. Hamas has officially declared that its policy is to develop or smuggle even longer range missiles capable of reaching Israel's largest city Tel Aviv and its lifeblood, Ben Gurion Airport. It has promised to keep aiming its missiles at civilian targets until the Jewish state is finally destroyed.

If this is not an "armed attack" under Article 51, then I don't know what is. The only argument against it being an armed attack is that rocketing civilian population centers, as Hamas is doing, is a war-crime. International law prohibits, even during a declared war, the deliberate targeting of civilians or the bombing of areas of civilian population centers with absolutely no military significance. But war-crimes may also constitute an armed attack: Hitler's invasion of Poland was both, as the Nuremberg Tribunal determined. If anything, an armed attack that is also a war crime justifies the right of self-defense even more than a mere armed attack. 

Nor can it be said that these attacks on Israeli towns and cities are merely the work of individual terrorists or terrorist groups. The military wing of Hamas is in fact a terrorist organization, as the Untied States and the European Community have recognized. But since Hamas is in political and military control of the liberated Gaza Strip, the military wing of Hamas is also the official army of that government, as Hamas itself has proclaimed.

What then are Israel's rights under international law, under the law of war, under historical precedents and under various treaties and human rights concepts? What have, and what would, other nations whose cities and towns were attacked by enemy rockets do? Israel certainly has the right to counterattack its enemy, destroy its capacity to fire rockets and engage in "belligerent reprisal." The only constraint on Israeli action is "proportionality." Israel's military actions must be proportional. But proportional to what? Certainly not to the actual number of people who have thus far been killed or injured by rocket attacks. Israel has spent an enormous amount of money building shelters to protect against rockets. Close to a thousand rockets have been aimed at southern Israel in recent years. Each one of them had the capacity to kill dozens, if not hundreds of civilians. The fact that no Hamas rocket has yet hit a school bus, a kindergarten, an ambulance, a synagogue, or a school yard is simply happenstance. It is only a matter of time until this happens. No nation has to wait until the goals of its enemy are fulfilled before it engages in a proportional response. Proportion must be defined by reference to the threat posed by the enemy and not by the harm it has produced. No nation need allow its enemies to play Russian Roulette with its children.

Israel has tried several options, each of which has been condemned by vocal members of the international community, human rights groups and religious organizations - some of whom have been silent about the Hamas war crimes that precipitated the Israeli actions. Israel has tried economic sanctions, border controls, targeted attacks on terrorists and ground incursions. Each of these generally acceptable war measures carry with it the risk of some civilian casualties. The reason for this is that the distinction between combatants and civilians has deliberately been blurred by Hamas. Rockets are fired from densely populated areas, precisely in order to force Israel into choosing between allowing its own civilians to continue to be killed by its inaction, or taking actions that risk hurting killing some Palestinian civilians. Either way Hamas wins. If Israel does nothing, then Hamas accuses it of impotence. If it does something, then Hamas accuses it if disproportionally. Hamas leader Khaled Maashal characterized Israel's military actions in Gaza as "the real Holocaust."  Even Mahmoud Abbas, the so-called moderate Palestinian leader in the West Bank said that Israel's military efforts to stop the rockets was "more than a Holocaust."

The time has come for Israel's critics to tell Israel what it should do in the face of these escalating rocket attacks on its civilian population centers. If economic sanctions, border controls, targeting terrorists and ground incursions should not be done, what are the alternatives?

The answer to this question is important not only to Israel, but to the United States and other democratic nations that will surely face the prospect of having to take actions to prevent terrorist attacks by enemies who deliberately hide among civilians. The barrage of unconstructive criticism directed against Israeli self-defense actions will only encourage more terrorism of this kind.

Yes, Israel initially shelled EMPTY fields in response to rockets and then even stopped this after some palestinians were killed. Israel is a disgrace and as a Jew, an embarassment. Olmerts remarks th eother day that Ashkelon will just have to get used to Grad rockets further bewilders me. Shame on you. Shame.

They do ...they spout the mantra of "ending the occupation". A catch all phrase that lets them off the hook - particularly when their perception of "occupation" is not just limited to Gaza. The concept of proportionately and fear of civilian casualties to the Gaza Arabs is bogus since these civilians voted Hamas into power. They aid, abet, shelter and support their murderers to the fullest. They are part and parcel to their war effort against the Jews of Israel. Only they can gain in a war of attrition. Israeli leadership is negligent in signaling that Jewish life is cheap. The world will never see the justice of Israel's side.

Having the opportunity to visit a history museum in Tel Aviv , the olny items in the holacost section were a suspended cage, soft violin music and a plaque that said "6 milllion Jews were slaughtered while the rest of the world stood by silently". The statement can be applied to the current events of today. Where is the outrage? Why are civilized societies bending over backwards to coddle a group of terrorists that have not only delcared, but aggressively continue to make WAR on the good people of Isreal? Wake up world, and stop "standing by silently".

If rockets were being launched from Tijuana to Southern California, I guarantee you the USA would carpet bomb the entire are without thinking twice about civilian casualties. Alan D.'s articulate analysis, using the international code of law, is so simple and basic, there can be no viable argument. Yet most of the world judges Israel (and Jews) differently. Hamas understands one language...that of terrorism. the law means little to them, but propaganda is the message. Israel's choices must not be controlled by the rest of the world. We (they) have a homeland to defend.

The only thing that will work in dramatically reducing rocket attacks on Isreal is the occupation of Gaza and the setting up of checkpoints there. The necessity of this course to preserve the safety /integrity of the State of Isreal should be the main focus of Isreal's diplomatic effort. As Alan points out you have a right to defend the existence of Isreal.

Diaspora Jews are good raising millions of dollars .The speech should have said Diaspora Jews should go to Israel & do military service. Israeli Youth have done their duty. In an article so concerned with the international law to designate Israeli presence in Gaza "occupation" is highly unthoughtful. Doing that prompts extrapolation to the West Bank as well. In both territories Israeli presence is not unlawful, as you of course know, and never was. The desirability of Israeli presence could be discussed and opinions split, but the term "occupation" should not be used at all, especially by the Israeli sympathizers.

Israel will know that it has reached the limits of proportionality when the rockets stop and the capacity to launch them ends. Whatever it takes to get to that point is well within the bounds of proportionality. However, the world media and their equally ignorant audience have become comfortable with the formula: "Israel = Occupier = Culprit = Responsible for Muslim threat". Nobody will be able to change this anymore, we've all tried in myriads of ways. This formula has the additonal advantage of conveniently satisfying anti-Semitic sentiment. The only thing that can produce a change is our (Israel's) settling of the borders so that there will be no more "Occupier" and the covert anti-Semitism will have to show its true face.

When children are massacred in a yeshiva, the international reaction is,"let's not be too hasty in your reaction". Alan, why are you so correct when it comes to Israeli politics, and so wrong about everything else. Last week I listened to a BBC calll-in broadcast regarding what to do about Gaza. A woman from Jerusalem called in to say that there was no humanitarian crisis in Gaza. Her argument was that if Hamas could afford to buy and smuggle thousands of missles into Gaza, they could certainly obtain the food and medicine that was needed by their people. That one comment, from my perspective, was the most insightful of the entire program. And, of course, it was completely ignored by the host.

If any other country was subjected to daily attacks as with Israel, the world would stand up (even the UN) and object fiercely. But Israel for whatever reason, does not receive the benefit of the world view. Imagine terrorists in Mexico shelling San Antonio. It would take all of one minute for a devistating response and not one organization would cry foul. I also think the liberal Dersh is wrong in many (most) views, but not this one.

I disagree with the learned Professor's comment: "the time has come for Israel's critics to tell Israel what it should do....", no matter how sarcastic the intent behind that comment (having listened to him many times before, I know his inclinations). Israel should NEVER expect any approval for ANY of its actions from its critics. Israel's critics expect nothing from Israel, and the Jewish people as a whole, short of laying down their arms and collectively being driven into the Mediterranean Sea.

This is of course a good question to ask the world. However, I would not hold my breath waiting for the worldÂ’s answer. Most of the worldÂ’s humanity is at best completely indifferent and many dislike Israel and Jews in general. To many the Jews just can never be right. They will never even bother to examine the justice of IsraelÂ’s cause because their minds have already been made up. May be the focus should be on what is the right thing to do for the nation instead of waiting for approval; while of course continuing to state our case clearly to the world.

All the writers agree that Israel cannot expect fair play from the majority of the world. Thus, it has to define its own rules of the game: increase the power of operations against Gaza's terrorists till they stop firing rockets and preparing for war. This is proportionality: no need to use more power to stop the terrorist war than necessary. How painful is to listen to unfair criticism of Israel, it is much more painful to hear of Israelis killed by the terrorists. So, in my view, either Olmert has the guts to stop terrorism from Gaza or he should resign to allow another leader to do this.

Great article, this is something I have been saying for quite a while. The only difference is Israel should give the World, UN, Security Council a time limit to come up with a solution. Not a solution already attempted. After this period expires, Israel has the right to wage war as war should be waged. If civilians are caught up in the fighting, this is on Hamas not Israel. the battle must be furious using the full might of the IDF to send a message, Israel will not stand for this type of attack. This is the only respnse that will act as a deterent and bring some semblence of calm.

What is the difference between Alan Dershowitz's “Double Standard Watch: Hamas has declared war on Israel - how should Israel respond?” and Larry Derfner 's “Rattling the Cage: Terrorism, theirs and ours?” The difference is simply between sanity and pathology. Alan Dershowitz is a trained human rights lawyer while Larry Derfner is not . More importantly, Alan Dershowitz understands the basics of our ethics. Larry Derfner understands nothing. He has completely lost his moral compass.

What Israel can do is sincerely pursue peace with the Palestinian people. All your fancy talk can not obscure the fact that the only road map Israel is following is one of charade and obfuscation. The settler population of the West Bank has soared, the area accessible to Pals has shrunk, the number of roadblocks has increased and hope has been extinguished . Hamas has pursued genocide. It has also successfully used Arafat's legacy of combining terrorism with politics. Result? During WW2 did anyone provide a humanitarian aid to German or Japanese civilians? They voted Nazis in power and got what they deserved. The same is true with Palestinians in Gaza. Capitulate first, otherwise don't complain. There is even an easier way - just stop your terror activities and everything will be fine. That's what should be told them by UN. Instead Israel is getting blamed for everything. What a crazy world !

I believe, Israel has an option in this situation that allows to avoid civilian casualtie and to be in complience with international practice: Israel should inter deep into Gaza in about 5-7 miles adjucent to Sderot, remove all Arab civilians from that area deeper into Gaza under control of Hamas, declare that area military zone and annex the area to the State of Israel. As a result of war, hostile entity under the government of Hamas will lose the terrirory, which is consistent with the international law and practice.

Just a correction Mr. Dershowitz: You claim that "no Hamas rocket has yet hit ... a synagogue", but this is untrue. I visited a synagogue in Sderot that had a DIRECT hit, but thank God the people had all left literally minutes earlier. If you would like more information then I can point you to actual video footage of the attack.

I think Isreal should link its response to Hamas' missile attacks with its housing policy on the West Bank as follows: for each rocket that lands on Israeli soil, it should precommit to adding another house for the settlers. Let Hamas determine the pace of settlement expansion by its own actions.

I keep hearing the word proportinality repeated over and over by almost everyone. I am at a loss to understand its application when one is under attack. If they kill 3 members of my family, it's OK to kill 3 of theirs but not 4 ? To my mind, the only reasonable application of self defense is to totally eliminate the threat by what ever means are quickest and most effective. What is currently happening in Israel (and Gaza) is prolonged agony. A quick clean cut is the least painful in the long run.

If the populace has elected a representative government who has declared war on Israel, the goverment is belligerent and it's populace are 'open hunting ground' within confines of conventions. However, if tantamount to the populace taking up arms, then convention ceases and the populace itself - in its entirety - become enemy combatants. NO MORE REASON FOR KID GLOVE TREATMENT OF CIVILIANS. Why is it that world opinion denies Israel the right to defend it's self? It's time the so called civilized world pulled it's head out of the sand, fired the Secretary general of the UN ( he is laughable ) and accepted the facts. The Palestinians do not want peace with Israel, so let Israel deal with this problem once and for all. Israel can dictate the " take it or leave it" terms as it is obvious that Palestinians are not willing to negotiate. Unfortunately this peace may have to be achieved by Superior Firepower.

What is proportionality anyhow? A recipe for failure. It allows your enemies to dictate the tone and scope of battle. Proportionality in this instance is whatever it takes to silence the missles and mortars flying in from Gaza. What would the Germans do if the Poles allowed, much less supported, a terrorist group to launch missles from Poland into Germany? What would the US do if mortars were flying in to San Diego from Tia Juana? After all, isn't San Diego occupied Mexican territory?

It is a pleasure to be able to agree with Mr. Dershowitz once and a while, a very rare event for me. To live in Gaza and have only Hamas representing you and determining your fate may be a new benchmark in hopeless and fatal slavery. It is hard for me to accept that fathers and mothers want this for themselves and their children. Is that the limit to the creativity of the Gazan's? Is their only tool death?

Can't Israel get their hands on some Kassam and Katyusha rockets? I say, an eye for an eye. Every rocket attack at Sderot on civilians gets a rocket attack on Gaza as a response... Who am I kidding? The UN and human rights groups would probably say, "It's unfair that Israel retaliates with the same proportion of rockets; everyone knows Israelis have better aim than Palestinians!"

Alan's argument is spot on, but people believe what they want anyway. His voice only reaches the choir. Let's face it, the world is growing alarmingly anti-semitic. We will never get a "fair shake," and must always use every legitimate means to level the field. The world needs a new leader to calm this morass. After months of watching Mr Obama, he might be the only one who can achieve this. So was Bush good for the Jews and the world? Unfortunately, we know this answer.

The State of Israel must chart its own course for survival. First, is an honest appraisal of the 'Peace Process' failure, both with Oslo and Annapolis. Whatever residual peace remains, will be a by-product of an all out IDF assault on the Gaza Palestinian Hamas encampment. Only an unconditional surrender by Hamas (the defacto government) will suffice; anything less is another holding pattern for the Israeli military. Article 51 of the United Nations Charter guarantee is a moot point, when Israeli citizens are faced with the Hamas barbarians at the gate.

I don't understand how your leadership can allow this to happen to your own people. When fellow palestiant supporter King Hussien of Jordan saw the lawlessness and threat to Jordanian life brought upon by the people who he accepted as guests, he chose to wipe kill 3000 of those ungreatful and trouble making palestinians. And your, who have been on the defence ever since your birth are more keen on protecting the palestinain terrorist leaders and their civilians over your people. Shame on your leaders. IF Sharon was here, Hamas would have been out long ago.

1. First of all, launch a diplomatic offensive and bring out the points that are brought out here. 2. Target each and every Hamas leader including Hananiah 3. Launch a ground + air offensive with adequate support and military personal. 4. Kill or arrest the leaders in #2 5. Kill any Hamas foot soldiers along the way. 6. Search and destroy any Hamas weopons and rockets If anyone can do the above, it's Israel! More power to you guys!

Every normal person would agree that Hamas is both waging war and committing war-crimes against Israel.Most goyiim-including many Americans-would openly (or tacitly) justify Hamas' actions by dismissing the victims as "only" Jews.So,in their view,who cares?It is past time for Israel's leaders to stop worrying about world public opinion and START worrying about defending the Jews.

It is time to protest against those who tell Israel that it cannot defend itself. We need to protest the upcoming visit of Jimmy Carter, Kofi Annan, and Mary Robinson. We need to be in the street letting these three "Elders" that we will not stand by as they help Hamas with its goals of destroying Israel and killing the Jewish People. And we need to protest against Oxfam, Save the Children, and Catholic Relief Servicse for their support of Hamas. We need to turn our words into action, both in Israel, the US, and Europe.

This article misses one important point: Israelis no longer want to fight. Olmert/Barak/Livni are not apparitions; they reflect the feelings of the majority of Israelis, who would rather give up half the country than kill Arabs. This Europeanized mindset governs how Israel responds to attacks - lots of talk, bombing empty buildings, but tryiong hard NOT to kill the enemy. Fear of how they will look on BBC and CCN. So it is over. It is only a matter of time until Israel basically surrenders.
