Double Standard Watch: Goldstone report is an ad hominem attack Posted by Alan M. Dershowitz

The definition of the ad hominem fallacy is to respond to substantive arguments solely by attacking the person who offered them. The mirror image of this classic fallacy is to try to bolster arguments solely by praising the person who offered them. This is what is happening with respect to the notorious Goldstone report regarding Israel's conduct during the Gaza War. Had Richard Goldstone, a distinguished judge and a prominent Jew, not been the author of the United Nations Human Rights Council report on Israel, it would be tossed in the trash barrel along with other one-sided and biased reports by this prejudiced group which targets only Israel for human rights violations. But those seeking to defend this indefensible report point to Goldstone's authorship as proof that it must have credibility. He has in effect placed his "Hechsher," that is, his religious certification of purity, on this impure report. It is appropriate, therefore, to respond to this argument by discrediting its author and his selfish motives for granting his imprimatur to conclusions which he well knows are false, incomplete, misleading and bigoted. Indeed, Goldstone and his supporters are acknowledging to Jewish friends that he did have a motive in agreeing to head the group that issued the report. His motive, according to his supporters, was to bring some balance to a report that without his input would have been "even worse." Goldstone's daughter, Nicole, in an obviously pained interview with Haaretz, said, "Had Richard Goldstone not served as the head of the UN inquiry into the Gaza War, the accusations against Israel would have been harsher." She continued: "My father took on the job, for peace, for everyone and also for Israel." She told The Jerusalem Post, "My dad loves Israel and it wasn't easy for him to see and hear what happened. I think he heard and saw things he didn't expect to see and hear ." The problem is not what Goldstone saw and heard. It's what he willfully and deliberately refused to see and hear. He refused to watch videotapes, easily accessible on the Internet, that show conclusively that Hamas terrorists routinely fired rockets from behind human shields. He refused to credit eyewitness reports published by reputable newspapers, and even admissions by Hamas leaders. He willfully refused to listen to the testimony of one of the world's leading experts on how democratic militaries fight asymmetrical wars against terrorists who hide behind civilians. Here is what Colonel Richard Kemp, who commanded British forces in Afghanistan in 2003, told the media, but couldn't tell the Goldstone Commission - because they didn't want to listen to him:
When asked why Kemp was not allowed to testify, this is what Goldstone shamefully said:
But all the IDF's actions took place during the course of a difficult military operation designed to stop rockets fired from civilian areas from targeting a million Israeli children, women and other civilians. The basic flaw of the Goldstone report is that, without a scintilla of evidence, the commissioners concluded that the Israeli military action in Gaza was motivated not so much by the defense of its citizens but rather by desire to punish Palestinian civilians. Based on that unproven, untrue and biased conclusion, the commission was then able to ignore massive evidence, much of it self-proving and easily available on the Internet, that the Israeli army did everything it could to reduce civilians casualties, while engaged in a military action designed to prevent the murder of its own civilians. Only a fool or a knave could ignore this massive evidence of Israeli efforts to comply with international humanitarian law. Only a fool or a knave would fail to see that Israel has done more to reduce civilian casualties that virtually any other country fighting a comparable war. Only a fool or a knave would allow his name to be attached to such a deeply flawed report. Richard Goldstone is not a fool. The Goldstone report should be rejected on its demerits. The added fact that it was authored by a self-aggrandizing Jew - selected precisely because he is a Jew with aspirations to be honored by the international community - should diminish, rather than increase, its credibility.

Perhaps the readers of Alan's article should also read Ben Dror Yemini's article published in Maariv (translated to English). In this article, Yemini calls Goldstone, and rightly so, a criminal. Ben Dror wrote his article after thoroughly reading Goldstone's report.

Goldstone's bias was clear from the start. He chose Christine Chinkin as his chief investigator. Chinkin declared Israel a war criminal before she was appointed by Goldstone. This is a grotesque violation of the code of judicial conduct and Goldstone knows it. Goldstone craves the publicity and rewards that come with being an anti-Israel activist. He shamefully has allowed his Jewish ancestry to be used by the anti-Israel movement. Everything that Professor Dershowitz says about Goldstone is true.

That very same reason should diminish, rather than increase the credibility of ANYTHING Mr. Dershowitz writes! If anyone fits the definition of "self-aggrandizing Jew" it is the author of the so-called "double standard watch."

I suppose, when Mr. Dershowitz talks about ad hominem attacks, we should believe him because he is an expert. Ad hominem attacks constitute his favorite way of arguing. Alternatively, Mr. Dershowitz's accusing anyone of ad hominem attacks is an illustration of a hutzpah - the type exepmlified by a story of a man who kiils his parents and then asks the court for the leniency because he is an orphan.

Hey, Dershy - how do you dare to claim to know more than the esteemed judge Goldstone from your armchair ? Have you seen the evidence, have you been present ? Have you visited Gaza? If Israel had participated in the proceedings as it was invited to do, it could have presented "the truth" you claim to know. Goldstone did not hear and see many things because the Israeli Government refused to cooperate in the investigation. The conclusions of the report would probably have been different if he had a chance to look into the other side of the story.
Second, and this is very serious, the press was NOT allowed to document the operation.

Goldstone wants desperately to be acceped in the salons of Europe and to be honored by the professors who lead the boycott Israel movement. It is sad to see aan in late middle age still tortured by his Jewish roots. Goldstone should be pitied.

Other prominent Jewish jurists had refused to accept the United Nations Human Rights Council request to investigate Israel because the terms of reference set out condemnatory statements in advance against Israel. Richard Goldstone took on this assignment because he has an enduring hatred of Likud governments. As a famous man once said, "it takes a lifetime to build a reputation but just five minutes to destroy one". In this case, Goldstone destroyed his own reputation by using his Jewish ancestry to collaborate with a biased anti-Israel entity. He betrayed Israel and the jewish people trying to further his own career. A very shameful act. He is a disgrace not only to jews and Israel but to all humanity. Who would want to be a friend to such an individual, not me. Who would even want to associate with such an individual? I find him disgusting, revolting, and of low moral caliber. Shame on him.

Richard Goldstone wants attention. He wants to be considered a hero, the man who stoood up to the evil Israelis and to the world Jewish community. This will allow him to receive a hero's welcome in Sweden, where the foreign minister will give him an award. It will allow Goldstone to be lionized on the editorial pages of the Guardian and in fact that has already taken place. It already gave him the oped pages of the New York Times, where Goldstone bragged about his heroism and his courage and how he stood toe to toe with the IDF. How sad a man you are, Mr. Goldstone.

Based on Obama's UN Speech, the most anti-Israeli speech since perhaps Jimmy Carter's post-presidential speeches, I would definitely say he was a hundred percent in line with Goldstone. So then, help me out - why is Alan Dershowitz such a huge Obama supporter? I'll just never understand it.

I stand with Israel. I feel much compassion for civilians caught in this mess but I don't see any other way for Israel to servive. P.S.Attempts by any country to divide Jerusalem, will only bring division to their own land as is happening in the USA.

The Dershowitz response is the classic, ADL, Bnai Brith, answer to every critique of Israeli military action, "avoid mentioning the evidence"for fear of hurting Israel. Once again, no mention is ever made of what the report actually says. Gaza was a disaster for Israels reputation. Denying what happened isnt going to work this time. Goldstone has found compelling evidence of war crimes - evidence of summary executions for example. Who in Israel wants soldiers doing this with impunity? What is being asked is for israel to investigate this substantive evidence. Quit name calling. Investigate.

Goldstone's rejecting an expert witness due to the supposed irrelevance of the issue of the difficulty of fighting a campaign against terrorists hiding in a civilian zone is absolutely shocking -- there ought to be a UN investigation of the Goldstone Commission! I submit that it be headed by an impartial Palestinian, say Walid Shoebat.
I'm actually not a huge fan of Dershowitz, but this piece demonstrates why he gained the status he has.

In a nutshell, any Jew should have been skeptical of being named to head this committee. If the report found Israel guilty, then "even a Jew agrees that Israel is guilty," and if innocent, "then the report is biased, because of course a Jew would claim Israel innocent." So the obvious question is, which Jew would agree to accept the post? The answer is, of course, a Jew who wanted to be loved by the anti-Israel camp. Because any Jew wanting to help Israel would have steered clear. And we see that in this case, Goldstone only wanted to help ingratiate himself into the Israel basher's club.

Goldstone seems to forget that the issue is not "two states" or "East Jerusalem". It is existential. As long at the Palestinians and the Arab League can dictate to American oil companies, in the US, that they can not hire US citizen, chemical and petroleum engineers, of the Jewish faith, to work in the United States ("Secondary Boycott") the issue is existential. They have demonstrated that they want to "cleanse the world of Jews."

Goldstone did not listen to the other side. He accepted every lie frm Hamas support eyewitnesses, just like Jenin.
Hamas fired rockets at Israeli citizens from mosques, ambulances, school grounds, hospital griounds etc. Every rocket fired from thiose places made them legal military targets.

Whether or not he is a fool needs to be assessed on the basis of how close did he come to his goal. And that goal had nothing to with defense of justice and truth, but of securing his prominence and image in the eyes of fools, knaves, haters and moral imbeciles. I hope there is a new young crop of intellectuals (also cijr) of similar calibre to carry on the defence of israel and the outrageous lies spewed by the arab, iranian and even european propaganda machine.
these guys are getting old and the struggle for truth has a long way to go.
surely though , the significance of the UN must fade altogether as anyone with half a brain can see the farcical nature of this risible body.

I think the only way to make people understand the truth and reality of life in Israel, is to make our own report. A report that will investigate all the victims of terrorism in the 8 years prior to the operation in Gaza. Victims of the "Intifada", victims of the missiles attacs on us. We have left Gaza, uprooted the settlement, took the army out. Gaza was left with only Hamas and civilians. No jews... And they fired rockets, and they didn't stop. And half of our citizens could not leave their home in the morning to go to work, to school. Children stayed home and were very much afraid.

Excellent article. Not only does Hamas use the vulnerable of their populations as human shields, they further abuse their own children by poisoning their minds with senseless hatred and suicidal ideations. Children drink antisemitism with their mother's milk. These ideologies can be easily accessed via the internet. Where is the outcry from Amnesty International or the UN or Red Cross etc, for the denial of basic rights to a 19 year old Israeli soldier, when Palestinian prisoners are so well cared for by their Israeli captors? Does Jewish blood have the same value that it did in 1938??
