Double Standard Watch: Dishonest Intelligence Posted by Alan M. Dershowitz

In December of 2007, I wrote an article about the National Intelligence Estimate that had just concluded that Iran had abandoned its nuclear weapons program back in 2003. The immediate effect of this pollyanna-ish report was to diminish the need for tough sanctions against Iran and take the military option off the table. We now know that the conclusion reached in the report was categorically false, and that those who issued the report knew it was false. I entitled my December 2007 article "Stupid Intelligence," because as I argued in it, its author had fallen hook, line and sinker for a transparent "bait and switch" tactic employed by Iran.
It was clear to many perceptive readers of the report, and to most other intelligence agencies, that Iran had simply - and deceptively - opted for the second track, and had certainly not abandoned its nuclear weapons program. It now turns out that at the time this "stupid intelligence" estimate was released, our intelligence agencies were aware that the Iranians were building a secret military facility buried deep in the mountains near the holy city of Qom. The United States recently disclosed the existence of this facility (after Iran was forced to acknowledge its existence) together with its firm conclusion that it could be used only for the development of a nuclear weapons program. If the intelligence community knew then what they know now, then its 2007 National Intelligence Estimate was not only stupid, it was dishonest. It seems clear in retrospect, as it seemed clear to me at the time, that those who released this deeply flawed report had a political agenda. As I wrote two years ago:
Whatever the agenda was, it is improper - indeed it is illegal - for intelligence agencies to try to influence policy through a hidden agenda. Their job is to report truthfully to the elected policy makers so that they can make policy. The time has come to withdraw the false and dangerous 2007 report, to admit it was wrong, and to substitute an intelligent, honest, objective and up-to-date report on just how close Iran now is to being able to construct a deliverable nuclear bomb. The issue of how to deal with the threat posed by an apocalyptic, terrorist nation on the verge of obtaining nuclear weapons is too important to be left to politicized intelligence agencies with hidden agendas.

The writing is on the wall. The West will dither while Obama tries to show he is the greatest President ever to live by negotiating with Iran, he will be hailed as a genius right up until the moment Iran tests it's first nuclear weapon.
Here is the real difficulty, Can Israel launch a military strike while negotiations are in process? You know these negotiations will continue up to the bomb test. So, any strike would have to be conducted during negotiations. Will Israel do it?

Dear Mr. Dershowitz : Almost every one of your excellent JP columns contradicts the letter (or at least the spirit) of Obama's positions, yet you do not utter a word in criticism of Obama. The closest you come to conceding Obama is wrong is when you make an excuse for him ( " I wish he had been more careful") . The truth is, of course, Obama ia anti-Israel at his CORE - why do you think he made the U.S. reinstate its membership in the UNHRC the day after he was inaugurated ? You don't think he knew the UNHRC was rabidly anti-Israel ? Ditto for his advisors, who include HATERS.

Well,who be screwing with who,this indicates a lack of trust,i think Israel will be best served my standing up the best intel force possible and compliment that by info from closest freinds,but still verify that,spy STUFF lends itself to paranoia,that said Mr. Cheyney and Condi were very honorable leaders,more moraliity there then almost anywhere,they surely weren`t deceiving people,current events already have shown who`s credible and trustworthy and who`s scratching heads,don`t fret ,learn from it and don`t repeat,watch out for those who`s scales are out of balance.

Where is the evidence, Mr Dershowitz? The IAEA just cleared Iran of any weapons program. Its very strange you are looking to the past, instead of looking at present truth. Its all reminiscent of putting pressure on the CIA to invent proof of WMDs in Iraq in the lead up to the 2003 invasion. Forgeries like the yellow cake from Niger, or those aluminum tubes that were not weapons-related. In any case, let's say it is correct. Iran used the same staling tactics that Israel did when they worked on their nuclear weapons. And really, there is no way anyone is going to bomb Qom.

In most cases intelligence reports are correct if looked at in total but governments like to release only the parts that help their policies and newsmedia twists the wording to give the ideal they are looking for. The orginal US CIA intelligence on Iraq was correct but most of them were fired and replaced to get the intel that would help the US plan to invade.
While the intel said that Iran was not trying to make nukes currently, which was true to a point, it also said that they were gaining the ability to make them at some point later if needed. The press must give all the facts but rarely.

The 2007 NIE report is already disregarded by Obama & his Administration. Obama himself, as well as Sec of State Clinton, Sec of Defense Gates, & Adm Mullen of the Joint Chiefs of Staff, have all publicly said that they believe Iran is working to develop nuclear weapons.

It appears that you are entirely correct. But, I ask, were Rice, Gates, and the president unaware that the report back then was a dangerous fabrication? Since Iran was sending in arms, terrorists, and more through Syria and Afghanistan to kill American soldiers, was Cheney wrong to want to defeat Iran? He was certainly correct, since that is where the real source of our problems were, then and now -I ran. The buck stops at Bush's office. He was elected for a second term based on his performance, weak in many respects, during his FIRST term. The 2nd term was a disaster with Rice & Co.

"Stupid Intelligence" is Mr. Dershowitz's middle name, or at least it ought to be. That NIE report is the culmination of bureacratic malfeasence which is the hallmark of Democrat policies. Yet Mr. Dershowitz is unshakeable in his support for these repellent people. "Stupid Intelligence", indeed.

AB is absolutely right, Prof. Dershowitz. I greatly admire your support of Israel and civil liberties - and you are always a gentleman. But, come on: support for Israel by the Democrats is simply a tactic. With few exceptions, they don't give a damn whether the Jewish state survives or not. After watching PM Netanyahu's UN speech and contrasting it with Pres. Obama's, my wife and I started asking ourselves who the real "big brother" in this relationship is! (P.S. I wonder if there's something we could do with Bibi's birth certificate?)

I have to agree with #1 AB. It is not just some mistakes or even a moderate political agenda one is dealing with here but a focussed plan to take Israel apart and to radically alter the world consensus as to what is acceptable and what is not. Academic intellectual freedom when it is in any way opposed to collectivist agendas is already decidedly uncomfortable in many "seats of learning" and is set to become among the heresies of the very near future. Where was Dershowitz when Obama was sitting at the head of the UN Security Council last week--with the Qom disclosure in his pocket--preening to a world audience about his "vision" for a world free of nuclear weapons? If Democrats like Dershowitz are serious about national security (or anything else for that matter) they need to start speaking up before Obama's naivte and ideaology do us all in.

To your credit, you recognized that some in our security agencies intended to sabotage the policies of those ELECTED to run the government. But this is only one of many instances in which unelected bureaucrats have tried to substitute themselves in policy matters for those ELECTED and held responsible for policies and decisions they make. In analyzing US intelligence reports it is important to recognize the precedent of delivering what the current administration wants. Until a means is developed to rectify this reality there can be no imptovement and any attempts to correct bad intelligence become a whitewash. AB, you are correct. Alan is a lefty. He is, though, dead on correct about issues related to Israel's security. I am amazed that the American Jewish vote swings strongly towards the left. (I know the history but fascists believe in a state run,private sector. A state run private sector is a concept of the left.) American Jews who have an affinity with Israel can't be happy with Obama. Soon more American Jews will start voting Republican. IIf so, Florida votes Republican. It is hard for Democrat victories with Florida firmly in the Republican camp.

Okay, so the intelligence report had a hidden agenda, avoiding a war with Iran. Whether the writers knew of Qom..I don't know? Maybe? If they did, why the fuss? Even Qom, now open to the IAEA, is questionable as to it's purpose? Until Iran tests an atomic device..we won't be sure, will we? Israel has 400 nukes, yet denies same. Does it? Have computer models determined it's nuke capabiiliy?
If another (updated) report, then what? What has changed? Will Obama and Gates approve bombing Iran's plants? Will Israel tempt fate? I say, so what? Iran will do what Iran will do.

So you don't print my earlier comments on Iran having sufficient materials for 7 fission bombs, and only being stuck in their trying to miniaturize a device to fit on a Shahab-3 rocket? Well now, the IAEA publicly "assesses that Iran has sufficient information to be able to design and produce a workable implosion nuclear device" based on highly enriched uranium. The report, " describes a complex program run by Iran's Defense Ministry "aimed at the development of a nuclear payload to be delivered using the Shahab 3 missile system." Get with it Alan.

by millions on PBS. He also appears occasionally on CBS. From time to time, he suggests that
those involved in making legitimate actions which might be construed as torture, or those people
who promoted the Iraqi invasion..be tried, be held accountable. I say, hows about
prosecuting the people per this article..in intelligence. I mean their lies could have

I am an Independed and voted for John McCain. I saw through the do-nothing President and his
outrageous promises to CHANGE everything, from the grassroots. That approach got him
the teenage vote and the votes of fanciful minorities who believe in Takkun Olam..heal the world and treat their maladies..before your own. He didn't disappoint me..nothing he had proposed has come to fruition..AND he has flip flopped..Iraq, Afghanistan, labor, world trade, gays in the military, etc. He has the majorities in Congress...so what?
